How Turn A Franchise Agreement To Your Advantage

Deciding to buy a Franchise is a huge decision. Once you have convinced yourself that franchising suits your character and business aspirations, have identified the right franchise, done your sums, attended the initial training and perhaps paid an initial deposit you will be presented with a Franchise Agreement to sign.

Typically this agreement could run to 40 or 50 pages and can be a daunting read to those unfamiliar with commercial contracts. The very nature of a franchise business structure means that the agreement will be fairly complex. Remember that this document provides the framework for your business life over the next seven years or so.

Franchisors, particularly established ones, will rarely change or negotiate the terms of their standard Franchise Agreement as they will want to maintain uniformity across all the franchises. However, it is essential that you understand what you are being asked to sign. Once you have signed an agreement as a business person (without the cotton wool treatment given to consumers) you will struggle to persuade a court later that the terms were unfair or sufficiently unreasonable to be void. You will be stuck with it! I strongly recommend that you seek legal advice from a commercial solicitor familiar with franchising.

Key areas include establishing the true cost of the franchise including ongoing royalties, advertising costs, minimum stock purchases. What location and territorial rights have been granted? Are these exclusive to you? What property and equipment is required? What obligations are there on you and the Franchisor relating to the ongoing operation of the franchise?

Often the most complex area relates to renewal and termination of the franchise. Are you granted an automatic renewal right beyond the franchise term of 5 or 7 years? What renewal fee is payable? Can you sell the franchise on? Usually you will need to give the franchisor first option and/or a right of veto over the acceptability of any proposed transferee, often coupled with a % fee. What are the consequences of an early termination by you if you want or need to get out prematurely? There will usually be a minimum period with forfeiture of the franchise fee, stock and possibly other financial penalties and compensation. What if you are in breach? What circumstances would lead to an automatic termination? Are you given a period in which to remedy your breach?

Ask yourself some "What if?" scenarios. What if you died or were seriously ill? What if you failed to meet your sales targets? What if you wanted to sell product out of your territory? What if a customer sued you for faulty products? If you cannot answer all your What ifs, do seek more advice. Don't be afraid to ask the Franchisor these questions. But don't expect an impartial response. The Franchise Agreement will usually have an express term preventing any reliance upon representations or claims made by the Franchisor in the initial presentations or documentation. Much to the disappointment of many clients who come to us for advice having run an unsuccessful franchise, this applies particularly to any claims as to how much money can be earnt… Buyer beware!

Domestic Merchant Account Options

A domestic merchant account may be the best option for your company. That’s because when you have an account managed by a company located in your country of residence, both you and the lender are familiar with laws and business codes that can impact the way your company operates. An offshore entity, in contrast, may be less familiar with and less observant of the rules that govern spending and payment transactions in your country.

Your domestic merchant account may be beneficial in other ways, as well. When selecting a lender, you can choose one that you know something about. Perhaps you have had other dealing with this bank or institution, or you may know other business owners who maintain accounts there. It is likely, if you follow business news, that you have read something about the corporation and are aware of its standing in the professional community or the overall industry. Working with a company that you know and trust can help to build solid relationships that can blossom into additional promising directions. You may be able to secure other types of accounts or lending in the future if your merchant account turns out to be a rewarding experience for both parties.

Applying for a domestic merchant account may be easier than doing business with an offshore company. You might be able to visit a local bank or one of its branches, or you might even know someone who works there. With a foreign bank, however, you probably won’t know any of the employees, and you are not likely to get the chance of visiting in person. However, you can possibly apply online for both domestic and offshore merchant accounts, and communication with company representatives should not be a problem due to the latest technological innovations that put people in touch instantly with those around the globe.

Fees for a domestic merchant account may be easier to understand when they are posted in the currency of your native land. Conversely, it may take some figuring to calculate profits and fees from currencies in other regions. However, many merchant account lenders do a good job of making this part easy, and will promptly process payments from other countries so that they enter your account in your homeland currency. Yet following the financial news in your own dollar, peso, or euro can be easier than trying to determine the value of currency you understand. If you do opt for an offshore merchant account provider, follow the financial news in that country via media like radio, television, print, or Internet to get a sense of how things are going and any impact your account might experience as a result.

Obtaining a merchant services account is a terrific way to expand the way you do business. Accepting credit payments from customers in countries around the world can be a great way to increase profits while lowering costs. When weighing your options of partnering with a local or an international lender, check into the advantages of a domestic merchant account.

An Ecommerce Internet Merchant Account

Small business owners and home based entrepreneurs sometimes reach the point where they realize their company is ready to grow, and then they begin to consider the advantages of an ecommerce Internet merchant account. Those who accept merely cash or check payments may decide to increase the ways in which a customer can pay for goods or services. A merchant account will let business owners accept credit card payments in many different ways. That is why so many business people opt to apply for an Internet merchant account.

If you do not already have an Internet Website to promote your business, this would be a good time to put one in place by opening an Ecommerce Internet Merchant account. More and more, consumers are looking to the Internet to find companies that offer the products and terms they want. Conducting business on the Internet or through technological means is called “ecommerce,” sometimes spelled as “e-commerce,” and it is growing at a tremendously rapid rate. Once your Website is operational, you will want to update it often with your latest product lines and descriptions and price lists. Once customers from any other computer in the world know where to find you, chances are they will return time and again if they like your site; they might even bookmark it.

To keep customers coming back, get an Ecommerce Internet merchant account that will let you accept credit card payments. That way, customers can buy things at your store locations, whether online or at a physical site, and pay for them instantly. You won’t have to send out statements or wait for checks to arrive in the mail. Instead, your credit-processing feature will let them pay with a credit card, and your underwriter can facilitate the payment by converting currency and deposit profits in your account, using real time.

An ecommerce Internet merchant account can put you leagues ahead of other companies in your industry. While they still take just check or cash payments, you can be busy processing credit card payments that could push your sales volume to new record heights. Naturally, you will want to keep your store looking attractive, and your Website should offer helpful information that will make guests want to return and possibly even bookmark your site for frequent reference. When the word gets out that you are accepting credit payments, more customers may browse your Website to check out your wares and plunk down a credit card in payment. One of the nice things about using credit is its convenience. Customers don’t have to worry about carrying enough cash or making an account deposit before going shopping. Start A Hauling/Shopping/Taxi Business

Here is a simple business anyone with a van or SUV can perform: haul stuff for other people who don't have a way to do it themselves.

You could move lawn mowers, bags of garden soil, playground equipment, Christmas trees, musical instruments, furniture, big dogs from the groomers-you get the idea.

Starting this home business is easy. Make sure your vehicle is in good shape. Be sure your car insurance is up to date. You don't want any trouble if your vehicle should get into a fender-bender.

Now, print up flyers advertising your business. Place the flyers in furniture stores, garden centers, grocery stores, laundromats, and wherever else you can find a bulletin board. College bulletin boards are prime hunting grounds for business. Also, place ads in your local newspaper.

Once your business takes off your customers will soon be telling their friends, "Hey, I know a guy with a van who will haul it". Word of mouth is a priceless form of free advertising.

How much you should charge for your service depends on what you're hauling and how far you have to haul it. You want to keep the price reasonable, or word will spread of your high prices and your customers will go elsewhere. Reasonable prices and friendly reliable service will build your hauling service fast.

Here's another way to put your gas-guzzler to work: Start a grocery shopping service.

Your customers would call or fax their grocery order to the supermarket. Your customer gives you the money to pay for the groceries. You go to the store and pick up the order for your client.

The growing senior population would love this service. Make sure you place ads in the paper and flyers in supermarkets, laundromats, and senior citizen clubs.

Here's one more way you can put your vehicle to work! If you have a safe driving record you could provide a taxi service for senior citizens and any latchkey kids who need to get to an after school activity.

You could charge five or six dollars per trip. Give your frequent travelers a break by offering a free ride after a certain numbers of trips.

It would be wise to provide the parents of any kids you transport proof you can be trusted. If the parents say it isn't necessary then insist they check out your driving record, car insurance, and whether or not you have a criminal record. You are protecting yourself by doing this. Bad things happen. You don't want to get caught in the crossfire.

Make sure your vehicle is comfortable and clean for your travelers. Have a fully outfitted first aid kit, a primed fire hydrant, and a toolbox in your car. Accidents do happen, people, even to the safest of drivers. You need to consider the safety of your passengers so insist everyone buckle up.

Prove to be a reliable and trustworthy taxi service and many other parents will soon have you shipping their kids to and from soccer practice.

Hauling furniture, grocery shopping, and a taxi service. You use your vehicle to do these chores for yourself all the time. Start making money doing them for others!

Get A Credit Card Merchant Account

A card merchant account can put your business on the road to financial success. If your company is not yet accepting credit card payments, you are missing out on the powerful potential of this income stream. Many business owners who started taking credit card payments claim that their income has doubled while overhead costs have diminished. When you become eligible to receive credit card payments, you are likely to experience an increase in sales volume and chase fewer dud checks. To facilitate credit card payment, however, you will need to apply for a merchant account.

Start by finding a lender you can trust. This may be a bank you already work with, one that perhaps got your business started or helped it to grow to where it is today. If so, there is a good chance that the lender will continue working with you in this key operative. But if you do not have such a lender or if the one you do have does not seem eager or suitable for underwriting your merchant account, you will have to find another reputable bank, credit union, or other financial institution to facilitate this account.

Your card merchant account can make or break your company, so it is wise to spend time finding the best possible lender for this purpose. Don’t just grab the first deal to come along. Take time to shop the many available offers and compare terms before making a decision. All too often a new or small business owner will be dazzled by the array of benefits that suddenly become available through a merchant services card. Then, after implementing this account, expenses mount while income remains stable or falls and the company can experience a shortfall. Approximately 80% of small companies close their doors within two years. Don’t become a casualty of this predictor. If you are approved for a merchant account, use it according to your business plan or company budget. Avoid investing large amounts into questionable activities. Start small by purchasing or leasing a basic credit card processor for your physical location. Or get a wireless unit for deliveries or remote destinations. You don’t have to spend thousands of dollars to get started. Go it one step at a time until you see how your customers respond and what your potential growth is shaping up to be. At that point you can always add more services, like an e-check processor or a pager, if you find they are truly needed for continued growth.

After getting approval for your card merchant account, you usually can start accepting credit payments immediately. Make sure you understand the terms of your account, which often boils down to a per-transaction rate of perhaps 20 to 25 cents. Or you may be able to opt for a low-interest monthly fee that may or may not impose certain minimums. In other words, you will be charged a baseline amount for up to perhaps 1,000 credit transactions. If your company does not get that many, you still have to pay the baseline fee, but you will not have to pay more, even if you get 2,000 or 3,000 credit card transactions, although this can vary from one lender to another. Check with local or online lenders for more details on applying for a card merchant account.

Find The Best Merchant Account

Do you know where to find the best merchant account? If so, you probably already have one. If not, maybe it’s time to find out. A merchant account can open the door to e-commerce and position your company for unprecedented growth. The chief benefit sought by many business owners is the ability to process credit card payments. Studies suggest that people who pay with plastic tend to shop often and spend more. You can take advantage of this trend with a merchant account from a reliable lender.

Plenty of well-known or highly ranked banks and financial institutions offer what some consider as the best merchant account. Since not all of them can be the best, however, it’s really up to the client—that’s you—to decide which account plan will best help your business to grow. Much will depend on the fees involved with various services. For example, some lenders charge application fees while others do not. Other lenders expect you to pay annual membership fees. It is a good idea to check out the price lists at each lender’s site or to discuss these with an account representative before signing a contract. Some lenders are known for implementing a terrific credit processor with a combination terminal and printer. Others might be more widely recognized for their ability to support an Internet site that accepts credit payments. However, you might be more interested in a telephone ordering system with credit card payment options that will facilitate customer access to goods and services.

Whatever your credit processing needs, the best merchant account is the one that will help your company develop its potential. You need a company that is not too far above you to treat your business as a valuable client. You also want a lender with helpful customer support personnel who are available to answer questions and provide guidance when needed. You don’t want to wait on the telephone for 15 and 20 minutes for someone to take you off hold. Nor do you want to have fees increased unexpectedly so that your company’s budget must strain to meet payments.

The best merchant account is the one that you can trust to protect your company’s interests. You need a dependable provider who can offer quality equipment and reliable support or maintenance if needed. Your lender should be able to offer reasonable account fees and secure transmission on all customer transactions. When you look good, your lender looks good, and the customer benefits most from this type of positive win-win relationship.

To find the best merchant account, you may want to ask other business owners to recommend a lender they have worked with. Or you can browse testimonials on the Internet or in chat rooms. Never sign up with a merchant account lender who seems suspicious or about whom you know little. Your business is too valuable to take chance on losing all with an unknown underwriter who may be here today and gone tomorrow, so hold out to find the very best merchant account.
